Raisely Terms and Conditions

Definitions

• ‘Our’ or ‘we’ or ‘us’ means The Royal NZ Society for the Prevention of Cruelty to Animals.
• ‘You’ or ‘your’ or ‘yours’ means the user of SPCA Raisely website.
• ‘Device’ means a device such as a smartphone, tablet or smartwatch using an Android or iOS operating system.
• ‘Raisely’ means Raisely PTY Ltd, a private company registered in Australia.
• ‘Raisely platform’ means the online service provided by Raisely as a cost-effective way of collecting donations from the public via Devices.

When these terms apply

By using the SPCA website hosted on the Raisely platform on your Device (including by scanning a SPCA Raisely website QR code), you agree to:

• these Terms;
• the Raisely privacy statement; and
• the SPCA Privacy Policy.

We reserve the right to change these Terms from time to time by giving you any notice required by law, and by publishing the updated Terms on this page. If you continue to use our system or provide any personal information after the publication of updated Terms, this constitutes your agreement to the updated Terms.

These Terms are governed by and construed in accordance with the laws of New Zealand. If any provision or part of a provision of these Terms is illegal, invalid or unenforceable, it will be severed from these terms and the remaining provisions (or parts of provisions) will continue in full force and effect.

Your undertakings

You agree that in your use of the SPCA Raisely website, or engagement in other SPCA Raisely related activities, that:

1. Any promotion of your participation in this appeal will align with SPCA’s brand;
2. When dealing with the public, sponsors, and supporters, you will make it clear that you do not represent SPCA, but you are raising funds to support SPCA;

Our undertakings

Through your use of the SPCA Raisely website or participation in other SPCA Raisely activities, your personal information may be collected. We will:

1. Only use your personal information for the purpose you provided it to us. This includes for future marketing on other SPCA campaigns, only if you have consented to this during sign-up or donation.
2. Abide by our Privacy Policy.

Raisely

1. You accept that Raisely’s authority to process instructions on your Device comes from the use of the Raisely donation platform through the Device.
2. The Raisely donation platform is provided by Raisely, not SPCA. To the extent permitted by law, SPCA excludes liability for any loss suffered as a result of the use of the Raisely platform. Without limiting the above exclusion, you agree that, to the extent permitted by law, SPCA won’t be responsible for any direct or indirect loss or damage.

i. to your Device from any use or attempted use of the Raisely donation platform,

ii. if you can’t access or use the Raisely donation platform, or

iii. if any transaction fails or is declined when you use the Raisely donation platform.
